Labor laws are increasingly being improved by the government. With the rise of foreign investment projects in Vietnam, there is a growing demand for services related to Vietnamese workers managed by foreign enterprises, as well as the signing of labor contracts that must comply with international free trade agreements such as WTO, ASEAN, etc.

In this article, Azlink provides useful information regarding the process of obtaining a work permit for foreigners working in Vietnam.

The 2019 Labor Code and its implementation guidelines have made significant improvements, particularly in defining specific positions for foreign workers wishing to work in Vietnam. According to Decree 152/2020/ND-CP, foreign workers are allowed to work in Vietnam if they meet the requirements for positions such as Experts, Managers, or Executives in the country.

The general conditions include

– Must be in good health to work.

– Must not be a criminal or subject to criminal prosecution according to the laws of Vietnam and foreign laws.

Specific conditions
for each position include:

  • Managers are individuals who manage a company and are authorized to sign company transactions on behalf of the company according to the company’s charter. Managers are typically defined specifically in the company’s charter.

  • Experts are employees with at least a bachelor’s degree and at least 3 years of experience in the position for which they were trained, or those who have obtained a vocational certificate with at least 5 years of experience.

  • Technical workers are foreign employees who have at least a vocational school diploma and at least 3 years of experience in their trained position, or those who have at least 5 years of work experience in a technical field relevant to the proposed position in Vietnam.

  • Executives are individuals who are in charge and directly manage the subordinate units of an agency, organization, or enterprise. Subordinate units include branches, representative offices, and business locations, excluding subsidiaries.

Tương ứng với các điều kiện là việc cung cấp Giấy tờ chứng minh năng lực làm việc và phù hợp với từng vị trí là một vấn đề vô cùng quan trọng để người nước ngoài được cấp Giấy phép lao động.

Thêm vào đó, đối với các giấy tờ được cấp tại nước ngoài hoặc một quốc gia khác, các chuyên gia, nhà quản lý, lao động kỹ thuật này còn phải chuẩn bị các giấy tờ từ nước ngoài, thực hiện các thủ tục Chứng nhận lãnh sự và Hợp pháp hóa lãnh sự trước khi gửi về Việt Nam để thực hiện các thủ tục. Trên thực tế, tuỳ ngành nghề, hoàn cảnh của lao động nước ngoài có thể yêu cầu và cung cấp các giấy tờ khác nhau nhằm chứng minh một người nước ngoài là một chuyên gia, nhà quản lý hoặc lao động kỹ thuật.

The company should contact a lawyer for more specific advice to avoid preparing too many documents or not understanding the necessary paperwork correctly.

An important issue that companies wishing to employ foreign workers should pay special attention to is the timing for applying for a work permit. Specifically, at least 30 days before the intended employment of the foreign worker, the company must register the recruitment and obtain approval from the provincial or municipal People’s Committee. For example, if the company plans to sign a contract with a foreign worker on October 25, 2021, it must register the recruitment by September 24, 2021, at the latest, as per the regulations above.
